All fishing tournaments expose participants to the risks of injury from: falls from docks, electrocution, accidents while unloading and loading boats, boat collisions with other boats or objects such as docks or buoys, capsizing due to rough weather conditions or wakes from other boats, falling overboard, lightning and severe weather, exposure to elements, dehydration, fish hooks being lodged in eye or other body parts, and various other perils not mentioned above.
 

1. I understand the inherent risks involved in recreational fishing competitions, and by my signature, I hereby RELEASE, WAIVE, DISCHARGE, and HOLD HARMLESS, LONG ISLAND KAYAK BASS FISHING LLC, LIKBF Inc., LLC Events, property owners, and respective directors, officers, and volunteers (hereinafter referred to as THE ORGANIZATION) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by my person, or to any property belonging to me, while participating in LONG ISLAND KAYAK BASS FISHING Tournaments (hereinafter referred to as EVENTS).
    

2. I am fully aware of the risks and hazards connected with participating in the EVENTS, including the risk of physical injury, disability, or death, and I am voluntarily participating in said activities, and to enter the tournament locations and engage in such activity. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE, PERSONAL INJURY OR DEATH that may be sustained, or any loss or damage to property as a result of being engaged in an activity.
    

3. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the ORGANIZATION and PROPERTY OWNERS from any loss, liability, damage or costs that may incur due to participation in the EVENTS.
    

4. It is my express intent that this Release and Hold Harmless Agreement shall bind the members of my family and spouse (if any), if I am alive, and my heirs, assignees and personal representatives, if I am not alive, and shall be deemed as a RELEASE, WAIVER, AND DISCHARGE of the above named ORGANIZATION and PROPERTY OWNERS. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be governed by the laws of the State of New York.
    

5. I understand that the ORGANIZATION will not be responsible for any medical costs associated with any injury, while participating in the EVENTS.
    

6. I further agree to become familiar with the rules and regulations of the EVENTS. I will further assume complete risk of any activity done in violation of any rule, directive, or instruction.
    

7. I certify that I am physically fit, have sufficiently prepared or trained for participation in these EVENTS, and have not been advised otherwise by a qualified medical professional. I further certify that I have no medical or physical conditions that would impair my ability to safely participate in these EVENTS.
    

8. I hereby grant permission to the ORGANIZATION to use photographs, video recordings, or any likeness of me taken during the EVENTS for promotional and marketing purposes, without compensation or further approval.
    

9. If any portion of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be fully effective.
    

10. I understand that I am responsible for my own medical and accident insurance and that the ORGANIZATION does not provide such coverage.
     

11. If participant is under the age of 18, this waiver must be signed by a parent or legal guardian. The parent or legal guardian also agrees to the terms of this waiver on behalf of the minor and assumes all associated risks.
     

12. IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and that no statements or inducements, apart from the foregoing written agreement, have been made; I am fully competent and I execute this Release for full, adequate, and complete consideration fully intending to be bound by same.
     

13. Electronic Signature. The execution of this document by electronic mail or by any other electronic or digital means shall be deemed to constitute effective execution of this document. Any signature transmitted by facsimile, email or other electronic or digital means shall be deemed an original signature for all purposes.
